The radical Islamist regime of the Taliban affords an extensive view of the logic of Muslim fundamentalism regarding the public and private spheres. I argue that the Taliban de-privatized several life-spheres, "publicizing" religion and the body. The Taliban performed power as public spectacle, employing public executions, amputations and whippings. Religion, too, was to be completely public, as Habermas argues it was in Europe before the 18th century. As soon as they took Kabul, the Taliban insisted that all residents had to (...) say their five daily prayers, the men in mosques. Likewise, men were given six weeks to grow out their beards to a hand's length and to trim their moustaches in accordance with a literal reading of sayings about the Prophet Muhammad's appearance. The young female memoirist of life in Taliban Kabul, Latifa, reported that her middle class father complied with the new rule, but insisted, "My beard belongs to the Taliban, not to me!" The rendering public of religion made public property of every religious act. His body had a choice, of being conformed to the movements and shaping of religion, or of being tortured because of lack of compliance. This publicization of the believer's body resulted in an alienation from individuals of parts of themselves. Likewise, the gendered character of the public and private spheres, with women being confined to the private, is as visible in Taliban thinking as it is in Hegel. The expansion of the public realm of religion and morality by the Taliban had the effect of shrinking the private sphere and so constraining women further. Girls' schools were shuttered and many war widows were reduced to begging and risking sanctions for being in the street without a male guardian. Posters of Bollywood actresses were forbidden, and Kate Winslet was condemned to death in absentia for portraying a fornicator in The Titanic. It is argued that the goal of perfectly privatizing the female body lay behind these Draconian measures. (shrink)

This article explores the meaning of the root k-f-r in the Quran, questioning the practice of translating the noun kāfir as “infidel.” It argues for a distinction between the idiomatic phrasal verb kafara bi-, which does mean to reject or disbelieve, and the simple intransitive verb kafara and its deverbal nouns, which are used in the Quran in a large number of different ways. This polysemy is explored through contextual readings of Quran passages. It is argued that the noun kāfir, (...) unlike the verb kafara, is used only with regard to adherents of traditional polytheism and is not deployed in an unmodified way with regard to Jews and Christians. The possible influence on the Arabic kafara of Greek and Latin conceptions is also broached. (shrink)

In the international sphere, sovereignty and fundamental rights are often at odds, giving these rights little space for action and, in general, only after crisis has led to tragedy, and tragedy to disgrace. International Law, on the other hand, consistently succumbs to forms of domination and power, and its scope of action is often limited to certain codifications which are frequently suspended by political exception. Sixteenth century Dominican theologian, Francisco de Vitoria, established the principles for a Law of the people, (...) based on secular civil power that, while still exercising internal sovereignty, could defend and privilege the “rights of all men” over the exercise of power and private interest. This article focuses on this dispute to show Vitoria’s position, who long preceded the great declarations of human rights of the 18 th century, presenting an original doctrine within the framework of an emerging globalization and based on the defense of fundamental rights. Conducting research with vulnerable populations involves careful attention to the interests of individuals. Although it is generally understood that informed consent is a necessary prerequisite to research participation, it is less clear how to proceed when potential research participants lack the capacity to provide this informed consent. The rationale for assessing the assent or dissent of vulnerable individuals and obtaining informed consent by authorized representatives is discussed. Practical guidelines for recruitment of and data collection from people in the middle or (...) late stage of dementia are proposed. These guidelines were used by research assistants in a minimal risk study. (shrink)

Los textos publicados sobre el poshumanismo han ido creciendo en los últimos años, asimismo, la recepción del fenómeno se ha hecho cada vez más matizada y los análisis diversos. Tampoco han faltado las metáforas usadas para acercar el fenómeno, un tanto nuevo y desconocido, a otros más familiares. Entre estas metáforas, una de las primeras y, a nuestro juicio, más interesantes es la de Frankenstein. No obstante, su amplio uso, consideramos que falta un análisis más detallado de los motivos antropológicos (...) y las estrategias narrativas que encierra el uso de esta metáfora como critica al poshumanismo. Este artículo es un esfuerzo por llevar a cabo un ejercicio filosófico en un doble direccionamiento: de un lado, se asiste a la teorización y, de otro, se participa en la experiencia; niveles de lo idéntico. A partir de acá, se ponen en liza dos vías para llegar a un mismo espacio de florecimiento; los bordes por los que cercamos el sentido profundo del ser. Para eso, tomamos el valor poético que emerge de la obra del poeta argentino Hugo Mujica. (...) Allí se encontrarán elementos suficientes de análisis filosófico, especialmente en la obra de Heidegger y Lévinas, para después, no sólo acompañar sino acontecer en la experiencia propia la interpretación posible a lo profundo de su poesía. El método será el hermenéutico existencial, centrando lo hermenéutico en la contextualización e interpretación de la obra escrita, y lo existencial en el momento de interpretar poemas. In this paper, we try to expose the fundamental ideas at the basis of Jorge Millas’ axiology. First, we will expose synoptically the core of the legal philosophy that the Chilean thinker develops on his works on the subject, including his conception about philosophy in general , and about legal science in particular . Secondly, we will expose the epistemological suppositions of his legal philosophy , and his consequent conception of law’s essence , the legal rule and its foundation, and (...) the axiological theory that Millas develops on the basis of the distinction and relationship between “is” and “ought” . We conclude with a critical analysis that pretends to expose the strengths and weaknesses of the legal theory of this Chilean author. (shrink)

In this paper it is performed a historical account of the theoretical roots that grounded the following four key basic ideas of chemical equilibrium: ‘incomplete reaction’, ‘reversibility’, ‘equilibrium constant’ and ‘molecular dynamics’. These notions developed in nineteenth-century as a consequence of the evolution of the concept of chemical affinity. The discussion begins with the presentation of the earliest affinity table [‘Table des rapports’] published in 1718 by Geoffroy. Afterwards, it is examined Bergman’s compilation. The theory supporting this arrangement assumed that (...) chemical displacement reactions were complete and could not be reversed. It is analysed how Berthollet’s model showed the inadequacy of this view. His new conceptual considerations established that the amount of the substances involved in a reaction was an essential factor determining its direction, which accounted for the early concepts of incomplete reaction and reversibility. Guldberg and Waage specified the role of mass in chemical equilibrium reactions as they considered the concentrations of the chemicals involved, formulating the first chemical equilibrium mathematical equation that approximates what is called nowadays chemical equilibrium constant. Finally, it is presented how Pfaundler was the first to consider the kinetic theory in the interpretation of the macroscopic properties of equilibrium reactions. (shrink)

El siguiente trabajo analiza las acciones artísticas ligadas al Colectivo Escena Política que tuvieron lugar en la ciudad de Buenos Aires entre 2013 y 2016. Daremos cuenta de tres formas específicas de intervención artístico-política en el espacio público. La primera relacionada con una denuncia de la explotación laboral de los artistas escénicos en la ciudad. La segunda vinculada a prácticas micropolíticas que denominamos activismo de lo sensible. Y la tercera, relacionada con la lucha llevada adelante por la Asamblea Lopérfido Renunciá (...) Ya, en conjunto con organismos de derechos humanos. En última instancia, el artículo propone que la eficacia política del activismo artístico depende de su articulación sincrónica con las diversas luchas que atraviesan el entramado social. (shrink)

En este artículo nos proponemos exponer, a partir de los límites conceptuales encontrados a los planteamientos arqueo-genealógicos de Michel Foucault, la posibilidad de plantear, en dos momentos –arqueo-genealógico y gubernamental–, una “ética de la insubordinación reflexiva”. Es decir, una “ética de la libertad inmanente” al débil que al decir su palabra, denuncia y al denunciar cuestiona al tirano y su mundo al habar y actuar con –y por– los otros. Esta ética de la intersubjetividad planteada como una ética de la (...) insumisión concertada, crítica y deliberada, pensamos, puede derivar de ciertas “condiciones enunciativas” encontradas en las dos últimas investigaciones concernientes al “decir veraz” o el “hablar franco” expuestos en El gobierno de sí y de los otros y El coraje de la verdad. Some of the contemporary ethical debates have put in value the rational feature of feelings because of the estimative intentionality that is implied in them. In this context, some claim that the intentionality of emotions is a kind of value perception, as Phenomenology stressed at the beginning of the twentieth century, particularly Max Scheler, by analysing emotional Feeling [_Fühlen_] in the frame of emotional life. In order to extend the context of this philosophical debate, and after describing Scheler’s phenomenology of (...) feelings of the intentional and non-intentional emotional life, firstly, we defend _the_ _axiological_ _and_ _emotional_ _intentionality_ _as_ _double_ _intentionality_ that—in our understanding—Scheler analyses phenomenologically, while taking distance from Franz Brentano and Edmund Husserl’s intentional structure of estimative emotions. And, secondly, we propose a tentative interpretation of _the link_ between estimative and emotional double intentionality _as living_ _structure_ _of_ _ethical_ _life_, in the light of Martin Heidegger’s Hermeneutical Phenomenology.
